Welcome to European Spirit.
This website and online store are owned and operated by Montgard AB. Throughout the site, the terms “we”, “us”, “our” and “European Spirit” refer to European Spirit and Montgard AB.
European Spirit provides this website, including all information, content, features, tools, products and services available through it, subject to your acceptance of these Terms & Conditions and any policies referenced herein.
European Spirit uses Shopify as its e-commerce platform. Shopify enables us to present our online store, process orders, manage checkout functionality, and provide our services.
By visiting our website, browsing our products, placing an order, or purchasing from European Spirit, you agree to be bound by these Terms & Conditions. These Terms apply to all users of the website, including visitors, customers, and anyone who interacts with our services.
Please read these Terms carefully before using our website or placing an order.
Section 1 – Eligibility, Access and Account
By using this website or placing an order, you confirm that you are legally able to enter into a binding purchase contract under applicable law.
You may be required to provide certain information in order to place an order or use parts of our services. This may include your name, billing address, shipping address, telephone number, payment information, and other details required to process and fulfil your order.
You agree that all information provided to European Spirit is accurate, current and complete. You are responsible for maintaining the confidentiality of any account login details and for all activity that occurs under your account.
European Spirit reserves the right to refuse access, restrict use, suspend accounts, or cancel orders where we reasonably believe that these Terms have been breached or that misuse, fraud, or unauthorised activity has occurred.
Section 2 – Our Products
European Spirit creates personalised caps produced according to the customer’s selected specifications.
We make every effort to present our products, colours, materials, imagery, descriptions and details as accurately as possible. However, we cannot guarantee that your device or screen will display colours, proportions, textures or details with complete accuracy.
Minor variations may occur due to the personalised and made-to-order nature of our products. Such variations do not constitute a defect where they do not materially affect the appearance, function or quality of the product.
All product descriptions, product availability, designs, specifications and prices may be changed at any time without prior notice. We reserve the right to modify, discontinue or remove any product at our sole discretion.
Section 3 – Orders
When you place an order with European Spirit, you make an offer to purchase the selected product in accordance with these Terms.
An order is accepted only once it has been confirmed by European Spirit and payment has been successfully received and processed. We reserve the right to accept, decline, cancel, or limit any order at our discretion, including where we suspect fraud, misuse, payment issues, incorrect pricing, stock limitations, production restrictions, or errors in product information.
It is the customer’s responsibility to ensure that all order details are correct before placing an order. This includes personalisation details, spelling, sizing, colour selection, shipping information and billing information.
Once an order has been placed and production has begun, it cannot be cancelled, changed, returned or exchanged due to customer error, change of mind, incorrect size selection, spelling mistakes submitted by the customer, or personal preference.
Section 4 – Personalised Products and No Returns
All European Spirit caps are made to order and personalised according to the customer’s specific requirements.
Because each product is produced individually for the customer, all sales are final once production has begun.
European Spirit does not accept returns. European Spirit does not operate a return process. Products must not be sent back after delivery.
Personalised products cannot be returned, exchanged, or cancelled due to change of mind, customer preference, incorrect size selection, incorrect information provided by the customer, or any other reason related to personal choice.
This does not limit or exclude any statutory rights you may have under applicable consumer law in relation to faulty, damaged, incorrectly supplied, or not-as-described goods.
Any approved manufacturing defect or warranty issue will be handled as a defect claim, not as a return. Customers will not be required to send the product back.
Section 5 – Prices, Payment and Billing
All prices are displayed at the time of purchase and may be changed without prior notice. The price applicable to your order is the price shown at checkout when the order is placed.
You agree to provide current, complete and accurate purchase, billing and payment information for all orders placed through European Spirit.
You confirm that you are authorised to use the payment method provided in connection with your order.
Payments are processed through secure third-party payment providers. European Spirit does not directly store full payment card details.
We reserve the right to correct pricing errors, billing errors, typographical errors or other inaccuracies at any time. If an order has been placed based on incorrect pricing or inaccurate information, we may cancel the order and issue any applicable refund.
Section 6 – Shipping and Delivery
European Spirit products are currently sold only within the United Kingdom and are shipped from the United Kingdom.
Estimated delivery times are provided for guidance only and are not guaranteed. Delivery times may vary depending on production, fulfilment, courier handling, address accuracy, seasonal demand, operational delays, or circumstances beyond our control.
European Spirit is not responsible for delays caused by shipping carriers, incorrect delivery information provided by the customer, failed delivery attempts, customs processes where applicable, or events outside our reasonable control.
Risk in the product passes to the customer upon delivery to the address provided at checkout, unless otherwise required by applicable law.
The customer is responsible for ensuring that the delivery address is accurate, complete and accessible.
Section 7 – Defects, Claims and Warranty
European Spirit takes product quality seriously. If a product arrives with a manufacturing defect, the customer must submit a claim in accordance with our No Returns & Warranty Policy.
A manufacturing defect must be reported within the applicable claim period and supported by clear photographic evidence.
If a manufacturing defect claim is approved within 14 days of delivery, European Spirit may provide either a full refund or a free replacement product, depending on the nature of the issue and applicable consumer rights.
After the initial 14-day period, European Spirit provides a 2-year manufacturing warranty for approved manufacturing defects. During this extended warranty period, approved claims will be resolved with a free replacement product only, unless otherwise required by applicable law.
Customers are not required to return the original product for an approved defect or warranty claim.
The warranty does not cover damage caused after delivery, misuse, improper care, accidental damage, normal wear and tear, improper washing or storage, contact with water, chemicals, oils, perfumes or cleaning products, or failure to follow care instructions.
Section 8 – Intellectual Property
All content, materials and intellectual property displayed on or made available through the European Spirit website are owned by or licensed to Montgard AB and European Spirit.
This includes, but is not limited to, designs, product imagery, photographs, text, graphics, logos, trademarks, trade names, layouts, visual identity, website design, product descriptions, software, and all related intellectual property rights.
You may not copy, reproduce, distribute, modify, sell, license, exploit, publish, transmit, display, or create derivative works from any part of the website or services without our prior written permission.
Any unauthorised use of European Spirit’s intellectual property is strictly prohibited.
Section 9 – Third-Party Tools, Services and Links
Our website may include access to third-party tools, applications, services, payment providers, analytics tools, marketing platforms, shipping services, or external links.
These third-party services are provided by independent providers and may be subject to their own terms, conditions and privacy policies.
European Spirit does not control third-party websites or services and is not responsible for their content, accuracy, availability, security, policies, practices, or performance.
Your use of third-party tools, links or services is at your own discretion and risk.
Section 10 – Relationship with Shopify
European Spirit’s online store is powered by Shopify.
All purchases made through the European Spirit store are made directly between you and European Spirit. Shopify is not responsible for the products, order fulfilment, customer service, warranties, claims, or any transaction between you and European Spirit.
By using our store, you acknowledge that Shopify provides the platform infrastructure but is not a party to your purchase contract with European Spirit.
Section 11 – Errors, Inaccuracies and Omissions
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping information, availability, delivery estimates, or other content.
We reserve the right to correct any errors, inaccuracies or omissions, to change or update information, or to cancel orders if any information is inaccurate at any time, without prior notice.
We are under no obligation to update, amend or clarify information on the website except as required by law.
Section 12 – Prohibited Uses
You agree not to use the website, services, content or products for any unlawful, fraudulent, harmful or unauthorised purpose.
You must not:
• Violate any applicable law or regulation
• Infringe our intellectual property rights or the rights of others
• Submit false, misleading or inaccurate information
• Interfere with the security, functionality or operation of the website
• Attempt to gain unauthorised access to systems, accounts, data or services
• Use bots, scraping tools, automated systems or similar technologies to access or interact with the website without permission
• Upload or transmit viruses, malware or harmful code
• Harass, abuse, defame, intimidate or harm others
• Use the website or services in a way that damages European Spirit, Montgard AB, our customers, partners, providers or reputation
We reserve the right to suspend or terminate access to the website or services where prohibited use is suspected.
Section 13 – Limitation of Liability
To the fullest extent permitted by law, European Spirit, Montgard AB, our directors, employees, contractors, partners, service providers and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages arising from your use of the website, services, or products purchased through the website.
This includes, without limitation, loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, or other intangible losses.
Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any statutory rights that cannot be excluded under applicable law.
Section 14 – Indemnification
You agree to indemnify and hold harmless European Spirit, Montgard AB, our directors, employees, contractors, service providers, partners and affiliates from any claim, demand, loss, liability, damage, cost or expense arising out of your breach of these Terms, your misuse of the website or services, your violation of applicable law, or your infringement of any rights of a third party.
Section 15 – Force Majeure
European Spirit shall not be responsible for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control.
This may include, but is not limited to, strikes, labour disputes, supply chain disruption, production delays, transport disruption, courier delays, technical failures, cyber incidents, natural events, severe weather, governmental action, war, civil unrest, pandemics, power outages, or other circumstances beyond our reasonable control.
Section 16 – Termination
We may suspend, restrict or terminate your access to the website or services at any time if we reasonably believe that you have breached these Terms or used the website or services in an improper, unlawful or harmful manner.
Termination does not affect any rights or obligations that arose before termination, including payment obligations, intellectual property protections, limitations of liability, and dispute provisions.
Section 17 – Changes to These Terms
European Spirit may update or amend these Terms & Conditions from time to time.
The latest version will be published on this website. Continued use of the website or services after updated Terms have been published means that you accept the revised Terms.
It is your responsibility to review these Terms periodically.
Section 18 – Governing Law and Jurisdiction
These Terms & Conditions and any separate agreements through which European Spirit provides products or services shall be governed by and interpreted in accordance with the laws of Sweden.
You agree that the courts of Stockholm, Sweden shall have jurisdiction over disputes arising from or relating to these Terms, the website, or purchases made from European Spirit.
Nothing in this section limits or excludes any mandatory rights or protections you may have under applicable consumer law in the United Kingdom.
